Self Defense/Defense of Others/Defense of Property
Have you been charged with a crime for defending yourself, your family or your property? If so please contact us. You have the right to defend yourself!
The use of physical force against another person is justified and not a criminal offense when and to the extent a reasonable person would believe that physical force is immediately necessary to protect himself against another's use or attempted use of unlawful physical force. A person is also justified in using physical force to protect a third person from unlawful physical force. Finally, physical force may be used to prevent or terminate the commission of a criminal trespass.
In Arizona, the laws have changed recently regarding how self-defense is addressed in the court system. The burden of proof is now on the prosecution to convince the judge or jury that your actions did not constitute self-defense, rather than forcing you to prove your innocence. This has significantly increased the difficulty in prosecuting clients for assault charges when self-defense is raised.
Often people are arrested and charged with serious crimes for protecting themselves, their family or their property. Who is labeled the defendant and who is labeled the victim is often subjective. DeRienzo and Williams will investigate the facts, interview witnesses and staunchly defend your right to protect yourself against the violent acts of others.
